Who we are:
John Scott & Co. (JSCO) is an agency representing publishers (Clients) for the purposes of licensing content and selling foreign rights in the publisher’s name to other publishers (Customers). JSCO’s is a business to business relationship with both our Clients and our Customers.
Contact details that we retain:
In order to serve our function, we retain the following details of our Customers and Clients: Company name, Company physical and/or mailing addresses, and Company contact(s) including their Company email address, telephone and FAX numbers. We do not retain any personal details of our Company contacts.
These Customer and Client details are supplied to us by the Customers and Clients themselves. And from correspondence between Customers and Clients on foreign rights contracts established in the past.
Customer and Client details are held within our local computer network which is actively protected by Microsoft security tools. We do not share Customer and Client details with anyone except that we share Customer details with Clients for the purposes of dispatching material to customers for evaluation and for the purpose of establishing foreign rights contracts between Clients and Customers that we manage.
Because of the international nature of foreign rights, the sharing of Customer contact details with Clients may be across international borders and jurisdictions.
Legal Basis for retaining Contact details:
JSCO retains Customer and Client contact details using Legitimate Interest and Contract Management as the Legal Basis, as outlined in GDPR. Legitimate Interest in pre-contract contact since we are responding to specific inquiries from Customers who are requesting the service that we provide; and Contract Legal Basis for contact where we are discussing and managing an existing contract that we are responsible for administering.
How we use contact details:
We retain these details in order to correspond with Clients and Customers about foreign rights for publications that Customers express interest in. The goal of this correspondence is to establish foreign rights contracts and/or licenses. This involves email correspondence and telephone calls initiated by customers as well as the shipping of sample copies and/or the transfer of pdfs of Client’s publications for evaluation by Customers.
Also, we use Customer email addresses to make Customers aware of publications of our Clients for which Customers may be interested in purchasing foreign rights. This is done in the form of periodic newsletters sent via email using a marketing tool. Customers are in control of whether they receive our newsletters using a Customer controlled initial opt-in function and an ongoing opt-out function.
Customer and Client details are not used in any other way or for any other purpose other than those outlined above.
How long we retain contact details:
We will retain Customer and Client contact details for as long as we are engaged in business together. However, if we have entered into a foreign rights or licensing contract, we will retain any contact information associated with that contract for as long as that contract is active and then for as long as the contract’s proprietor wishes to keep it available for auditing and internal business review.
Periodically, we review our Privacy Statement to be sure that it is up to date and relevant. All changes we make will be posted to this page.
What are your rights?
If at any point you believe the details we have for you are incorrect you may request to see these details and have them corrected or deleted (deleted only if there are no ongoing contractual obligations). If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter.
If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law, you can complain to the Data Protection Commission in your jurisdiction.
